Distance Selling Agreement

1. Parties

This Distance Selling Agreement (“Agreement”) is entered into between:

  • Arvak & Sól, hereinafter referred to as the “Seller”, and

  • The individual or entity purchasing goods or services through the website www.arvakandsol.com, hereinafter referred to as the “Buyer”.

2. Subject and Scope

 This Agreement governs the rights and obligations of the parties concerning the sale and delivery of goods or services ordered by the Buyer electronically from the Seller’s website, in accordance with the Law on the Protection of Consumers No. 6502 and the Distance Contracts Regulation.

3. Product and Price Information

  • The Seller provides accurate and up-to-date information on product descriptions, prices, and features on the website.

  • Product images are for illustration purposes; minor differences in appearance or packaging may occur.

  • All prices displayed on the website are in Turkish Lira (TRY) and include applicable taxes unless otherwise stated.

4. Order and Contract Formation

  • Orders are placed electronically via the website.

  • Upon receipt of the order, the Seller sends an electronic confirmation to the Buyer.

  • The contract becomes valid when the order confirmation is delivered to the Buyer.

 5. Payment

  • Payment may be made via credit card, debit card, or other online payment methods offered by the Seller.

  • Payments are processed securely through authorized payment service providers.

  • The Seller is not responsible for any transaction errors caused by payment service providers.

6. Delivery

  • Delivery of products is carried out to the address provided by the Buyer.

  • Delivery times are indicative and may vary depending on product availability or shipping conditions.

  • In case of significant delays, the Buyer will be informed via e-mail or telephone.

  • Risk of loss or damage passes to the Buyer upon delivery of the goods.

 7. Right of Withdrawal

  • The Buyer has the right to withdraw from this Agreement within 14 calendar days from the date of product delivery, without providing any reason.

  • To exercise this right, the Buyer must notify the Seller in writing via email or the contact form available on the website.

  • Products must be returned unused, undamaged, in original packaging, and accompanied by the invoice.

  • Refunds will be made within 14 days following the Seller’s receipt of the returned goods.

 8. Returns and Refunds

  • Return shipping costs are borne by the Buyer, except when the goods are defective, damaged, or incorrectly delivered.

  • The Seller reserves the right to inspect the returned goods before processing a refund.

9. Defective or Damaged Goods

  • If the delivered products are defective or damaged, the Buyer must notify the Seller within a reasonable time.

  • The Seller will offer repair, replacement, or refund in accordance with applicable consumer protection laws.

10. Liability

  • The Seller is responsible for ensuring that the goods comply with the terms of the Agreement and relevant laws.

  • The Seller is not liable for losses resulting from improper use, negligence, or unauthorized modification of the goods by the Buyer.

 11. Governing Law and Jurisdiction

  • This Agreement is governed by the laws of the Republic of Turkey.

  • Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the Istanbul Courts and Enforcement Offices.
